Toyota is recalling 690,000 Tacoma pickup trucks throughout the United States due to a potential vulnerability in the suspension system.

The company says that the leaf springs at the back of the trucks could fracture and come loose when subjected to stress and corrosion.  While there are no reported injuries associated with the fault to date, Toyota has decided to recall the truck.

The Tacoma recall applies to the Tacoma 4x4 and Tacoma Pre-Runner's manufactured in 2005 through 2011.  Read more about the recall here.

Tips To Help You Drive Safely This Fall

350 Old Country Road, Suite 205, Garden City, NY 11530

Are you ready for cool weather and changing leaves?  As you prepare for the fall season, we remind you to stay safe when driving on the roads.  Here are a few driving hazards to keep in mind as the seasons change.

Autumn Road Hazards:
  • Fallen Leaves - Although fallen leaves are beautiful, they can also be slippery and dangerous when wet.  Keep an eye out for patches of wet leaves when you are driving.
  • Reduced Visibility - Daylight savings time is ending. This means that your visibility will be reduced when driving.  Use caution when driving and watch out for pedestrians and bicyclists.
  • Changing Tire Pressure - The weather changes frequently from day to day in the fall.  These temperature changes can cause your tires to lose air pressure. Make sure they are properly inflated.
  • Sun Glare - Keep a good pair of sunglasses available in your car to counter any glare.  The sun will be rising and setting at new times that might affect your driving.

Understanding Your Lease

350 Old Country Road, Suite 205, Garden City, NY 11530
877-791-8076 / StoberLaw.com

Do you understand the terms of your apartment lease?  We know that the length and language can seem intimidating to new and experienced apartment hunters alike.   However, having a basic understanding of your lease agreement can help you avoid unnecessary disagreements in the future.

What is a Lease?
Any contract between a landlord and a tenant which contains the terms and conditions of rental is considered a lease. A lease cannot be changed or altered during the time it is in effect unless both parties agree. Make sure your landlord has not exhibited any changes to the lease that you may be unaware of.

Rent Charges
A landlord can charge any rent agreed upon by the parties if an apartment is unregulated. In a regulated situation, in any one year, the landlord may charge an increase of up to six percent of the tenant’s rent.  Increased hardship or labor costs can also cause an increase in rent.

Eviction
Any tenant with a lease is protected from eviction during the lease period so long as the tenant does not violate and substantial provision of the lease or any local housing laws or codes.

If you have any questions or concerns pertaining to your rental situation, feel free to give us a call at 877.791.8076. We are glad to speak with you and help you understand the terms and conditions of your lease.

New Radars May be Able Detect Texting & Driving

350 Old Country Road, Suite 205, Garden City, NY 11530
877-791-8076 / StoberLaw.com

There has been a huge crack down on texting and driving in New York State.  Soon, a new technology may even be able to detect distracted drivers that would otherwise go unnoticed.  ComSonics, a company based in Virginia, is developing a new radar gun that could target your vehicle and detect a texting signal.

Cell phones emit radio frequencies when they are being used for data, voice calling and texting.  These radio frequencies can be picked up and detected, even if the phone is out of view of any passerby.

However, proving that the text was sent by the driver could be difficult for vehicles with multiple occupants.

The device is in production, but will still need to be tested before it can be adopted and approved by any law enforcement agencies in the United States.  Read more about the new gadget here.

Warning Labels To Be Posted on North Hempstead Utility Poles

350 Old Country Road, Suite 205, Garden City, NY 11530
877-791-8076 / StoberLaw.com

A new North Hempstead law requires warning labels to be posted on utility poles.  The local municipality wants residents to be aware that the poles contain a hazardous preservative chemical.

While Pentachlorophenol, the chemical used to preserve wooden utility poles, is banned for public use in the United States, it is allowed to be used in wood utility poles, railroad ties, and other limited industrial uses.

The new warning labels will say:

“This pole contains a hazardous chemical.  Avoid prolonged direct contact with this pole.  Wash hands or other exposed areas thoroughly if contact is made.”

According to the Environmental Protection Agency, pentachlorophenol is extremely toxic when ingested or inhaled.  However, PSEG stated that it is safer to work on treated wooden poles because they lessen the risk of electrocution.

Newsday offers more information on the chemical and the warning labels that will be placed on local utility poles.

Just one day before the anticipated launch of the iPhone 6, Nassau County released plans to combat texting and driving.  This plan will include new court practices, as well as engage the tech industry and insurance industries to improve driver safety.

The Plan:
  • Urge cellphone manufacturers to incorporate texting block technologies into the smartphone operating system.
  • Ask insurance carriers to provide discounts to drivers who use applications that block texting on their devices.
  • Recommend that sentencing courts adopt a specific plea program that includes text-block technology.  Where any charge is reduced as part of a guilty plea, use of such devices, at the cost of the offender.
  • Request that law-enforcement agencies issue more tickets for violations, when appropriate.
  • Increase public awareness with safety apps and other resources.
