Fair Labor Standards Act

The Fair Labor Standards Act (FLSA) establishes minimum wage, overtime pay, recordkeeping, and youth employment standards.  It is important that employers comply with these regulations to ensure fair employment practices.  Here are a couple of the issues covered under the act.
  • Minimum Wage – New York State’s minimum wage increased to $8 an hour on December 31, 2013.  The minimum wage is set to increase to $8.75 per hour on December 31st, 2014 and to $9.00 per hour on December 31st, 2015.
  • Overtime – Nonexempt employees must receive overtime pay for hours over the 40 hours per workweek.  However, under the FLSA, there is not requirement for overtime on weekends or holidays.
